A Message From the Official Committee Regarding the Debtor's Proposed Plan
Dear Creditors of the Nathan and Miriam Barnert Memorial Hospital Association:
A number of Creditors of the Nathan and Miriam Barnert Memorial Hospital Association have contacted our office to inquire about the Official Committee of Unsecured Creditors' (the "Committee") position with respect to the Debtor's proposed First Amended Plan of Liquidation (the "Plan").
In general, the Committee supports the Debtor's Plan. However, we do have some specific objections which we raised in the Committee's June 16, 2008 Limited Objection to the Debtor's Proposed Disclosure Statement and Plan (the "Limited Objection"). A copy of the Committee's Limited Objection can be found at www.barnertinfo.com , Docket - Main, 883.0. Also available at www.barnertinfo.com , Docket - Main, 940.0 and 941.0, are copies of the Debtor's First Amended Disclosure Statement and proposed Plan.
If you agree with the concerns raised by the Committee in the Limited Objection, we propose that you complete your ballot for Acceptance or Rejection of the Plan by designating "Rejects the Plan" and adding an additional comment on the ballot which states that "This Rejection, however, shall be deemed an Acceptance of the Debtor's proposed Plan if the Committee's objections are resolved."
